After being sued by Take-Two back in May for breach of contract concerning Duke Nukem Forever, developer 3D Realms and affiliate Apogee Software responded with a counterclaim on June 19 for a breach of contract by Take-Two, concerning an unannounced title tentatively known as 'Duke Begins' and further details on Duke Nukem Forever.
Take-Two's original lawsuit against 3D Realms back in May dealt with Duke Nukem Forever, which the developer had reported that it could not finish development on the title after they had to lay off much of their employees.
Apogee Software, [with which developer 3D Realms is incorporated], [previously countersued] publisher Take-Two, who recently filed suit against 3D Realms for allegedly failing to deliver the long-awaited FPS, Duke Nukem Forever.
Tex.-based 3D Realms said in its counterclaim filed on June 19 (originally uncovered by GamePolitics, and subsequently obtained by Gamasutra) that negotiations with Take-Two regarding development of the Xbox 360 version of Duke Nukem Forever fell through on May 1, 2009.

I'm still wondering why people still give a *bleep* about Duke...
If this was any other franchise, I'm pretty sure people would've trashed it and moved on by now. But...you know...that's just me.
Might as well say Doom was an Ultima clone with guns, since that was the inspiration for the game.
Not defending the console releases -- don't know much about them and they weren't even made by 3DR.
But yeah, the last game (excluding the mobile release) was made seven years ago. But..people still care. Because they feel it's a unique and fun series. Um. Not sure how to really progress this part of the conversation.
They didn't say "it will be done when it's done" -- you're confusing them with Blizzard, who say that for every game of theirs. The opposite is true here, which had made a lot of people angry -- they kept saying it would be released by a certain time, which never came to fruition.
They would've moved on, yes -- which is how this isn't just any old franchise.
Well...yeah, 12 years is more than enough to make people get pissed. And that game deserves all the godawful puns it gets too.
if it wasn't for the fact that the devs are Apogee and for Duke himself then yeah, nobody would care.
I enjoy the puns.
I'm still not sure what to make of DNF -- Apogee seems to be saying it was complications with its publisher that caused most of the delays...everyone else calls them slackers -- keep in mind over that 12 year period the game has to be rebuilt multiple times to accomodate new hardware, technology, etc. Even so, yes, it feels pretty absurd.
Anyway, who knows, really..I suppose we'll find out once the court case is eventually settled, assuming no trickery is pulled.
