Orinda sues Sony for Patent Infringement, Wants Sony to stop selling games

Gothic Girl | August 29, 2008 | News | Playstation 3 Company
Yet another company has felt the need to sue a game company for a supposed patent infringement. This time it's Orinda Intellectual Properties USA suing Sony. And why? Because they believe Sony are violating one of their (rather vague) patents that relates to manufacturing, recording and storing information on a disc.

Orinda are claiming that "Orinda has been and will continue to be damaged as a result of Defendants' infringing conduct," and are seeking to gain "a reasonable royalty" from Sony, as well as halt sales on all of Sony's Blu-Ray products, including games, DVDs and the PS3 console itself.

You know, sometimes these patent suits are justified. The Immersion stuff, that's fair enough, because Immersion actually make things that rumble. It's what they do. Stuff like this suit, though? It does little but take the piss. Orinda Intellectual Properties USA (the name says it all) have, on August 20, filed a suit against Sony, Sony Electronics, Sony Computer Entertainment and Sony Computer Entertainment America. They claim that the PS3's Blu-Ray drive (as well as other Sony BD players) violates a patent Orinda hold that relates to...storing data on a disc. Not only are the patent trolls asking for "a reasonable royalty", they want the sales of all Blu-Ray devices across America to be halted.

Good luck with that.

I'd like to know the people that think it's a good idea to sue a company much larger and powerful than your own. Although I do have a PS3, i'd like to know what would happen if they did win.

The PS3 wont die anytime soon. If it did then the 360 would win the console war! Oh noez.

It would cease the PS3 leaving over 13 million people with a brick that can only play games and blu-ray they had bought prior to the thing passing.

      Try actually 15 million.

Anyway I love how they only mention Sony but what about 360? I mean DVD-9 also stores information on discs, surely they're in violation of this.

No, Sony would just pay them royalties and that would be the end of it. They wouldn't go out of business from something this minor.

Oh... ok, in that case, I patent air. Anyone who breathes any form of air has to pay me a dollar every hour, otherwise everyone has to hold their breath

    Some people are just ridiculous

And Blu-Ray wasn't developed by only Sony, but other companies as well. The amount of power these guys are facing is simply much too large for them to be able to squeeze a win out of this. xD

Lol wtf?? That's REALLY vague. Lol, If they won it would practically put sony out of business, Of course the courts will see sence though.

I can see it now, small company beaten to the ground by sony.

Usually I don't root for the bigger guy, but these guys are going to get creamed.

I don't mean to be rude but since I don't have a PS3 or anything else with blue ray (and therefore nothing to lose) a very evil part of me would love to see them win. It just seems like such a weird and funny concept, the PS3 killed like that. So unfortunately I seem to be on the other side to you on that, but just for the laugh more than anything.

Not a big deal. Sony will keep making games. Other companies will keep publishing blu-ray movies. If Orinda thinks they have a case they'll take everyone to court and lose. Or they'll win and Sony and others will have to pay royalties.

Or...to save hassle Sony will just say *bleep* it give them XX Million dollars and all will be good again.

Sony's lawyers would bury these guys so far in paperwork that we will be playing PS5 before they figure out WTF happened.

Sony isn't going to stop making games and everything because one little company (that I've never heard of, btw) tries to sue it over something very vague. They'd fail hard.
