An avid Resistance player was banned from the PlayStation Network. He felt his claims were worthy of a day in court and filed suit against Sony on July 6th. Alleging his Free Speech rights were violated.

Unfortunately players may get suspended from Sony’s PlayStation Network. If said player is especially naughty they will be banned. An avid Resistance: Fall of Man fan managed to get banned from PSN. Generally players will create a new user and take the loss. Only on this occasion this PSN user has filed suit in U.S. District Court in California against Sony.

When will people understand that being an ass isn't protected speech? If this case gets past Sony just stating the EULA and showing where he agreed to it, he wouldn't pass the Miller Test.

Estavallo is asking $55,000 in punitive damages, and also asks that Sony does not implement bans of any sort.
    Hahahahahahahahaha.

Not the first time the 1st amendment has been thrown around as such a flimsy defence when the person in question clearly has no idea what it even means. All they see is "freedom of speech" and think that grants them a right to say whatever the hell they want wherever they want without consequence.

Fortunately that isn't the case and this Erik will simply be the latest person to find this out.
