Problems with Xbox Live during the recent Christmas period have seen a trio of gamers in Texas slap Microsoft with a lawsuit looking for millions of dollars.

Filed at the U.S. District Court in Housten on behalf of themselves – and others having suffered through the online service’s recent unreliability – the three unsatisfied gamers are looking for in excess of $5 million USD in damages based on claims that Microsoft is in breach of contract and is liable for negligent misrepresentation.

        Taxes DO pay for it though. So in essence, yeah, most Americans do pay for postal service.

        Overall, I was under the impression that they weren't liable for this type of thing. Guess I was wrong.

    Wow how bs. I thought the holidays were for going out and spending time with family/friends, not staying home playing over Xbox Live all week...come on.

    Ok, so it's $50 for a year's service. What happens when your Internet starts to go down, and you have to call you ISP provider to get it up and running again? Don't we pay more for that service? You can't expect something to always run 100% with no flaws. I think the problem was a surplus of new Xbox Live members, and not all of us faced the Live connection problem.

    The Xbox Live crew promised to make up for it anyways, this is just to get fame and possible fortune...how lame.

    Stupid bastards. All they've now done is started down a road that shall cost them and they will gain nothing, only fame that has the caption of "Idiots attempted to sue Microsoft over stupid little thing, Microsoft pwned them". Not something to brag about. Poor gaming companies. They have to deal with stupid idiots and all they want is to create great games and consoles for the masses, and get rich off it too (but not everyone in the industry is in it for cash).

    Yeah. I'm just going to make a little compilation of all the sayings made so far: you shouldn't be spending the yuletide cooped inside your home playing XBox Live. Who'd be on anyways? And so, it cuts loose. Well, what else can you do? DS WiFi, presuming you have it, PS3 WiFi, presuming you have it... the possibilities are endless. Not to mention Internet. But rather, the trio decides to sue Microsoft for - no, not the yearly fee of $50 dollars - $5,000,000 bloody U.S.D. That could pay for 100,000 years of XBox Live, which won't be happening.

    Im tired of these idiotic lawsuits in the states. Just looking at someone the wrong way can land you a lawsuit or going to court. And if you have money and get good lawyers you win. Its sad. Whoever made it that you can sue anyone for any BS thing was a moron.

    And i really doubt they have a sliver of a chance of winning anyways. So why bother suing a company who could just sue you back and win. Its going to be interesting what MS does with these punks. I say sue the kids for 5 millions for false convictions.

    "Seasonal outages"? I may not have Xbox Live, but any gamer knows that no online service is invincible from the inevitable. Sometimes, a service as large as it is with the millions of 360'rs out there NEEDS maintenance, has to slow down for a bit. I am fairly sure the judicial system will throw this one out of court, and perchance it is upheld, well, then that's US LAW. welcome aboard =/
