Square Enix sues retailers of unlicensed Final Fantasy sword replicas

Remember around June when Square Enix filed a lawsuit against Ivy for her carbon copy of a Final Fantasy AC scene? Well it seems Square Enix has also filed a lawsuit for some unlicensed Final Fantasy sword replicas. Square means business, if you don't ask for permission you're going to get sued.
Square Enix (Final Fantasy, Dragon Quest) has announced it has filed a federal lawsuit in the Central District of California against several defendants it claims have infringed on its intellectual property.

The lawsuit focuses on at least four wholesale retailers who allegedly sold unlicensed replicas of swords that appear in Square Enix's Final Fantasy games -- specifically, four video games and one CG-animated film (the likely candidate, Advent Children, is not mentioned by name).

    God they are uptight. I understand why they are doing it and all, but they should chill out. If they really don't want them to sell FF sword replicas, then freaking ask, don't go straight to the suing.

      You don't understand, Its their merchandise, which means THEY own the rights to it. They never asked permission from Square if they can make this. And If they just allowed them to continue it, they won't be getting money from their merchandise they made popular with their games.

    No way, *bleep* that playISDF, I'm actually totally with them on this. It's entirely their property and considering how massively popular Final Fantasy is they're would be a killing made for stuff like this. They deserve it.

    Finalblade and jmac, I understand the fact that they own the rights and they deserve their fair share of the cash and such, but come on, it isn't cool that all of a sudden, out of *bleep*ing nowhere comes some letter saying "Hey we are SE, we know about you selling FF sword replica's, especially since we seized a crate from nowhere, so we're going to freakin sue you cause you didn't ask us first". They have every right to, but can't they just ask nicely to stop selling the swords and maybe give all the cash that they got from the swords back to SE if they really want it that badly?

    This also brings up a question of people who made replica's themselves at home for themselves (not common of course but I don't put it past people...like I know this one guy that does this kinda stuff). If SE finds out about them, are they gonna get sued for an insanely huge amount of cash just cause they made an FF sword for themselves? I mean come on, it's just a tad overboard. God I swear companies don't know how to resolve anything without lawyers or going to court these days.

      Tell that to IVY and her carbon copy of a Final Fantasy 7 AC clip. Listen they only knew about the swords since it made public, the people who made their own are fine as long as they keep it in their house and no show people in public.

      So what your saying is you wouldn't sue something if they copied your merchandise? Or MS and bungie wouldn't sue people who made Halo merchandise? Seriously they did the right thing at the end of the day.

    For all we know they were already served with a cease and desist letter. I have one of the replica swords I bought a couple years ago, so it's been going on for quite some time anyway. I'm just glad I'm not getting sued by SE........YET!! LMAO

      You're a consumer, they won't sue you for buying something unlicensed, just the people making money off of it...

      But we don't know the specifics, as you said, SE could have served a cease and desist order, which was ignored....

      Probably not, they likely got wind of this, and want money from this...

      Some people (companies especially) won't respond to nice letters, or requests....They WILL take notice if they're sued >_>

      I don't think they could sue people who bought this stuff, even if they tracked down the consumers. If nothing else, the consumers could play dumb, and say "I thought it WAS licensed", or "I didn't know it was so special", etc....

      Different in the case of say movies, games and programs though....You can get in trouble for using that stuff, if they find out. Especially if you use it knowingly >_>

        LOL yeah I am not worried about SE coming after any of the consumers, I was only teasing. SE is pretty jumpy at times with the FF franchise though. I don't blame them, but sometimes they seem more aggressive than others.

          Those replicas could make a lot of money though, and SE isn't getting a piece of that pie, so naturally, they might be a bit....annoyed >_>

      I've seen them at flea markets and sword shops all over the place.

      I can see why Square Enix is peeved over the unlicensed swords though.

    Play ISDF, I understand what you're trying to say about at least approaching them first before suing, but they should have known better to put themselves in this position to begin with. Its like if Nike were to take some Adidas shelltoes, slap a swoosh on them and sell them at Niketown without any questions asked.
