PlayStation Home can be downloaded already with a bit of basic "hacking" but is not yet playable. A simple hack using the PS3 Proxy Server application can fool the PS3 into think that Home is available to download and it even points you to the correct download file. Though after installation, you will find that it is unplayable. Video available via Source.
When PlayStation Home finally goes live, a new icon will automatically appear under the [Network] category, without the need to update your firmware. Upon booting your PS3, the console does a simple check on two XML files to see if the service is active in your country. If it is active, the new icon appears and click on it will download the Home package to your PS3. After a bit of "hacking" using PS3 Proxy Server, we managed to get the icon showing on our console and even downloaded the Home beta file. Unfortunately, since the service isn't yet active, we were unable to play.

Though it kinda shows how poor Sony are in able to set up "hidden or secret" features to do with the console as this just shows relaxation, especially in relation to the user accounts that could be hacked into.
Give it the same 3 years and the PS3 will probably have some of the same hacks, just wait for an upscale of the same emulators seen on the PSP XMB, and with the hardware the irony is that modders could stick Xbox 360 emulators on a firmware hacked PS3 if they found a way around, as far as i know they haven't but Sony wouldn't care... They would ban a handful to show a forceful we hate this but behind closed doors they are throwing champagne parties.
If not downloading it will become completely pointless.
